Terms of service
The agreement between you and the operator of this gateway for sending
WhatsApp messages through it.
Last updated 2026-09-09.
These terms are not finished. The operator's legal name,
contact address and jurisdiction have not been filled in. Set them in
OPERATOR in src/routes/legal.js, and have a
lawyer read this, before relying on it.
These terms are between you (“you”, the business using the service) and
[legal entity not set]
(“we”, “us”). By creating an account or sending a message through the
service you accept them.
What the service does
We provide an HTTP API and dashboard that queue your messages and send
them over the WhatsApp Business Platform, and that report back what
WhatsApp said happened to them.
We are the pipe, not the sender. Messages go out from WhatsApp numbers
you connect and control, under your own business identity, to
recipients you choose.
Your account
- Give accurate account details and keep them current.
-
Keep your API keys secret. They are bearer credentials: anything sent
with your key is treated as sent by you, and is your responsibility.
Tell us promptly if a key leaks so it can be revoked.
-
You are responsible for the WhatsApp numbers you connect and for
having the right to use them.
- Do not attempt to reach another customer's data, or to disrupt the service.
What you may send
You confirm that, for every message you send through us:
- you have the recipient's consent to message them on WhatsApp, on a lawful basis;
- the content is lawful, accurate, and not misleading about who is sending it;
-
it is not spam, malware, a phishing attempt, or an impersonation of
another business or person.
We do not read your messages in the ordinary course of operating the
service and we do not pre-screen them. If we are told about abuse we may
investigate, and may suspend sending to protect recipients, the service
or our standing with Meta.
Fees and messaging costs
Fees for the service are whatever we have agreed with you in writing.
Meta bills you directly for messaging. WhatsApp conversation
charges are set by Meta and are payable by you on the payment method
attached to your own WhatsApp Business Account. They are not part of any
fee you pay us, and we do not control or discount them.
Availability
We aim to keep the service running and will give notice of planned
maintenance where we reasonably can. Unless we have signed a separate
service level agreement with you, the service is provided as-is, with no
uptime guarantee.
A message accepted by the API is queued, not delivered. Delivery depends
on Meta, on the recipient's account, and on their device being online.
We do not guarantee that any message will be delivered, or delivered
within any period.
Liability
Neither of us is liable for indirect or consequential loss, or for loss
of profit, revenue, goodwill or data.
Our total liability arising out of the service, in any twelve-month
period, is limited to the fees you paid us in that period.
You are responsible for claims arising from the messages you send —
including from sending without consent, or content that breaks the law
or Meta's policies.
Nothing here limits liability that cannot be limited by law.
Ending it
You may close your account at any time by telling us. We may suspend or
close an account that breaks these terms, that puts our standing with
Meta at risk, or that has unpaid fees — with notice where circumstances
allow.
On closure we stop sending, and we delete your account, your message
records, your connected numbers and their stored access tokens, and your
API keys, as described in the
privacy policy. Export anything you
want to keep before you close the account.
Changes
We may change these terms. If a change materially affects you we will
tell you at your account contact address before it takes effect, and
continuing to use the service after that is acceptance. The date at the
top always reflects the current version.
